Due to the current recession, foreclosures on homes have become a big problem in the United States. The various reasons for the downturn in the economy including the housing crisis can be traced back to to many things including lax lending practices, greed, sky rocketing real estate prices, unemployment and the falling stock market. All of these factors have contributed to the massive foreclosure crisis that this country is facing. It is important for homeowners to know their rights if they are faced with foreclosure.
You have a variety of different options that you can look into and possibly take advantage of rather than lose your home. There is a forbearance from the bank. This is usually a special arrangment made with the bank that basically suspends your payments for a certain amount of time, or even lowers the payments for a certain amount of time, allowing you the time to get back on your feet financially. All of the missed payments plus interest are added to the outstanding balance of the loan. You will need to work closely with your lender to work something out that is suitable for the both of you.
Another option is to sell the property, especially if you have decided that it is not financially feasible for you to continue to live there. If there is a profit from the sale it is yours to keep. With the falling real estate prices and the slower real estate markets, this may not be a feasible option but you should try anyway. Homes are still selling, so you should at least try to sell the property.
Another way to avoid foreclosure is basically giving the house back to the lender. This method is referred to as deed in lieu of foreclosure. Both parties have to agree and it is an automatic offering from every lender. Of course, as the homeowner, you would not receive any equity in the house. But you can walk away without having a foreclosure on your credit, however, your credit will still be affected.
You have options if you are facing foreclosure. It is a very difficult to go through and can affect your life for many years to come. It is critical that you understand you rights and you are aware of what is going on and what could happen.
